Apple says latest fee structure to come into effect on 1 October, as EU seeks to force app competition

Apple has proposed changes to its fees in the EU for applications distributed outside its App Store, in a move to satisfy the requirements of the bloc’s Digital Markets Act competition rules.

The company said apps distributed through third-party app stores or direct online downloads would face a 5 percent surcharge on digital transactions, which it called a “Core Technology Commission”.

Apps distributed through the App Store that use non-Apple payment methods are to be charged a 20 percent commission, while apps using Apple’s payment method will be charged 26 percent.

Some of the fees can be reduced through participation in various programmes.

The tier of fees, which replaces a more complex system, is to take effect on 1 October, Apple said.

Apple last year introduced changes to its fee structure to comply with the DMA, but the European Commission said they continued to favour Apple’s own payment system, to the detriment of third-party methods, illegally inhibiting competition.

Apple said it believed the latest changes would resolve the dispute.

The Commission said it welcomed the changes, and would monitor their implementation.

Competition

The EU is the only jurisdiction where Apple currently allows direct app downloads, but Japan and Brazil have forced it to allow third-party app stores.

In the US, Apple is litigating over how much it can charge for third-party payments, after initially proposing fees similar to what it charges for App Store-based payments.

Fortnite developer Epic Games, which launched the US litigation around App Store fees, called the latest “Core Technology” charge “junk fees” and said the latest proposal was “meaningless” and didn’t comply with the DMA.
