A case in the US District Court for the Northern District of California considering the fees Apple can charge for transactions outside its App Store is to continue, after the Supreme Court rejected an emergency appeal.

The top court had earlier granted a one-day pause to give it more time to consider Apple’s request to suspend the lower court’s proceedings, while the Supreme Court considers a related appeal to a contempt-of-court decision.

The California district court case is part of the long-running antitrust battle between Apple and Epic Games that could have far-reaching effects on the terms Apple imposes on developers who use its App Store.

Apple had applied for proceedings in the California case to be suspended while the Supreme Court reviews a judge’s finding that held Apple in contempt of a court order telling it to allow developers to point users to cheaper payment options outside the App Store.

Apple allowed developers to do so, but imposed fees for such payments that were similar to payments made through the App Store.

US District Judge Yvonne Gonzalez Rogers found this violated her earlier ruling.

The Ninth Circuit upheld the contempt ruling, and the Supreme Court is likely to review it in December.

The original ruling, which found Apple in violation of California law and ordered it to allow third-party payment methods, was upheld by both the Ninth US Circuit Court of Appeals and the US Supreme Court.

The Ninth Circuit also upheld the contempt finding, but said Apple should be allowed to impose charges, and told Gonzalez Rogers to consider new arguments from the company over an “appropriate” level of compensation.

It is those proceedings in Oakland district court that will now go ahead.
